Terms of Service
The rules for using WineDNA — what we promise, what we do not, and what we expect from you.
1. Who these terms are with
These terms are an agreement between you and [TODO: legal entity], registered at [TODO: registered address], company registration number [TODO: company registration number] ("WineDNA", "we", "us").
They cover the WineDNA iOS app, this website, and any related services. By creating an account or using the service you accept them. If you do not accept them, do not use the service.
2. Age and eligibility
WineDNA is for adults only. You must be at least 18 years old, or older if the legal drinking age where you live is higher. We ask for your date of birth at sign-up to check this.
Creating an account by giving a false date of birth is a breach of these terms and we will close the account when we find out.
The service is offered where we are able to offer it lawfully. Some features — retailer offers in particular — may be unavailable or limited in your country.
3. Your account
You are responsible for keeping access to your account secure, and for what happens under it. Tell us promptly at [TODO: support contact email] if you think someone else has got in.
One account per person. Do not share credentials, and do not create an account on behalf of someone else without their authority.
The same account works in the iOS app and on the web. Signing in on one does not sign you out of the other.
4. What WineDNA is — and is not
WineDNA predicts how likely you are to enjoy a given wine, based on a taste profile derived from your own ratings. It is a personalised suggestion engine.
A Wine Match score is a probability estimate, not a promise. Palates change, bottles vary, and the model is only as good as the ratings it has seen. Where our confidence is low we say so.
WineDNA is not professional, medical, nutritional or investment advice. Do not use it to make decisions about your health, and do not treat wine as an investment on the strength of anything you read here.
Educational content about wine is exactly that — education. It is not an encouragement to drink more.
5. Acceptable use
When using WineDNA, you agree not to:
- post content that is unlawful, hateful, harassing, defamatory, sexually explicit, or that promotes harm — including harmful drinking;
- impersonate anyone, or misrepresent your connection to a producer, retailer or brand;
- post reviews you were paid to write without disclosing it, or otherwise manipulate ratings;
- scrape, bulk-download or resell the catalogue, our recommendations, or other users' content;
- reverse engineer the service, probe it for vulnerabilities without permission, or interfere with its operation;
- use the service to market alcohol to people below the legal drinking age;
- upload anything you do not have the rights to upload.
6. Content you post
You keep ownership of your ratings, tasting notes and photos. By posting them where other users can see them, you give us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce and display them for the purpose of operating and promoting the service. The licence ends when you delete the content, except for copies already in backups or retained for legal reasons.
We do not tolerate objectionable content. Every review can be reported and every author blocked from inside the app. We aim to act on reports within 24 hours and may remove content or suspend accounts without notice where the content is clearly abusive or unlawful.

7. Subscriptions and payment
Some features require a paid subscription. Subscriptions bought inside the iOS app are sold and billed by Apple through the App Store, and Apple's terms apply to that transaction.
Subscriptions renew automatically until cancelled. You cancel through your Apple ID subscription settings, not through us — deleting your WineDNA account does not cancel an active App Store subscription.
Refunds for App Store purchases are handled by Apple under Apple's policy. Your statutory rights as a consumer in the EU are unaffected.
If we change the price of a subscription, we will tell you in advance and you will have the chance to cancel before the change takes effect.
8. Prices, availability and retailers
Prices, stock levels, vintages and shop opening hours shown in WineDNA come from third parties and from data that ages quickly. We make no warranty that any of it is accurate, complete or current, and we are not a party to any purchase you make from a retailer.
Always check the price and the vintage on the retailer's own site before buying. Disputes about an order — delivery, condition, refunds — are between you and that retailer.
Linking to a shop is not an endorsement of that shop.
9. Affiliate disclosure
Some links to retailers are affiliate links: if you buy through them, WineDNA may receive a commission at no extra cost to you.
Commissions never influence your Wine Match score. The prediction is computed from your Taste DNA before any commercial offer is attached to a wine, and any paid or promoted placement is labelled as such wherever it appears.
We do not accept payment to raise a wine's match score, and we will not.
10. Alcohol and responsible use
WineDNA does not sell, ship or deliver alcohol. We show information and, where lawful, link to third-party retailers.
Please drink responsibly. Do not drink and drive. If you are pregnant, taking medication, or have any reason to avoid alcohol, follow medical advice rather than an app.
Alcohol advertising is regulated differently in different countries. Where local law restricts what we may show, we will restrict it, and some commercial features may be switched off in your market.
11. Intellectual property
The WineDNA name, logo, interface, taste model and catalogue presentation belong to us or our licensors. These terms do not transfer any of it to you. You get a personal, revocable, non-transferable right to use the app for your own, non-commercial purposes.
Producer names, labels and trademarks belong to their respective owners and are used to identify wines.
12. Changes, suspension and termination
We may add, change or withdraw features. Where a change materially reduces what you have paid for, we will tell you in advance and you may cancel.
We may suspend or close an account that breaches these terms, that is used unlawfully, or where we are legally required to. Where it is reasonable to do so we will warn you first and explain why.
You may stop using WineDNA and delete your account at any time.
13. Disclaimers and liability
The service is provided as it is. To the extent the law allows, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not warrant that the service will be uninterrupted or error-free.
We are liable for damage caused intentionally or by gross negligence, for death or personal injury caused by our negligence, and for anything else that cannot be excluded by law. Otherwise our total liability is limited to the amount you paid us in the 12 months before the event that caused the loss.
Nothing here limits the statutory rights you have as a consumer, including under EU and Polish consumer law. If a clause conflicts with a right you cannot waive, that right wins.

14. Governing law, jurisdiction and complaints
These terms are governed by Polish law, and the GDPR and other directly applicable EU law apply to the processing of your personal data. [TODO: confirm governing law once the legal entity and its seat are fixed.]
If you are a consumer resident in the EU, you keep the protection of the mandatory rules of your own country, and you may bring proceedings in the courts of your place of residence.
Please contact us first at [TODO: support contact email] — most things are resolved faster that way. If we cannot agree, EU consumer dispute resolution routes remain open to you, including your national consumer authority.
Privacy complaints can also go to the supervisory authority named in our Privacy Policy.
15. Changes to these terms
We will publish an updated version here and change the date at the top of the page. Where a change materially affects your rights, we will notify you in the app or by email before it takes effect. Continuing to use WineDNA after that date means you accept the new version.
